California Is Moving to Ban Engineered Stone — What That Means for Your Countertop Choice

If you are planning a Pasadena kitchen right now, the countertop decision you expected to make in ten minutes at a slab yard just got more complicated. In May, California's Occupational Safety and Health Standards Board voted to begin writing a rule that would prohibit fabricating and installing engineered stone — the material most people call quartz — when it contains more than one percent crystalline silica.

What California actually did

On May 21, 2026, the Standards Board granted Petition File No. 609, which asked the state to prohibit the fabrication and installation of engineered stone containing more than one percent crystalline silica. The Board granted the petition in part and directed Cal/OSHA to open emergency rulemaking to amend California's crystalline silica standard — Title 8, section 5204 — and to convene advisory committees to review it. Cal/OSHA held the first of those advisory meetings on July 31, 2026 in Oakland. Cal/OSHA's rulemaking page is the primary source, and it is worth reading rather than trusting a summary.

The driver is an occupational health emergency, not a design trend. The California Department of Public Health has been tracking silicosis among workers who cut and polish engineered stone. The documented case count since 2019 runs into the hundreds, with dozens of deaths and dozens more lung transplants — many of them young men working in Los Angeles County fabrication shops, a short drive from the kitchens those slabs end up in.

Two things worth being precise about: nothing is banned today, and the proposal targets fabrication and installation work, not ownership.

The part most articles get wrong

Silicosis comes from breathing respirable crystalline silica dust. That dust is created when a slab is cut, ground, edged and polished — in a fabrication shop, or in your driveway when someone dry-cuts a sink opening. A finished, installed countertop is inert. It does not shed silica, it does not off-gas, and there is no exposure pathway from cooking or eating on it.

So if you already have quartz counters: do nothing. This is not a recall, and you do not need to replace anything. If we thought otherwise, we would say so.

Why it still changes what we would specify today

Mid-project risk. An emergency standard, by definition, can take effect quickly. If it lands while your slab is on order or awaiting fabrication, the thing that waits is your kitchen — with the cabinets in and the sink disconnected. That risk is worth weighing against the cabinet decisions you are making at the same time.

Fabricator capacity. Shops that cannot meet current silica requirements are already closing or consolidating. Fewer shops means longer lead times, and a rushed fabricator is how you get visible seams in a 1920s house where nothing is square — a real concern in the Craftsman bungalows we restore across Pasadena and Altadena.

Low-silica alternatives now exist. Several manufacturers offer engineered stone formulated below the one-percent threshold. If you love the look, that is the version to ask about — by product name, with a written spec sheet, not a salesperson's reassurance.

How we rank the options right now

Large-format porcelain is our first choice. It shrugs off heat, UV and scratching, which matters in a climate where a west-facing kitchen window bakes a counter all afternoon and where covered-patio cooking is common — see our notes on outdoor kitchens in Pasadena. Slabs run large enough for near-seamless islands and full-height backsplashes. The catch is that porcelain is less forgiving to fabricate; edges and cutouts chip if handled casually, so installer experience counts for more here than with any other material.

Natural granite and soapstone come second. Both take hot cookware without complaint, and honed or leathered finishes read far more period-correct than a high-gloss engineered slab. One honest caveat we will not skip: natural stone is not silica-free either, and cutting granite also generates dust. The petition singles out engineered stone because its silica content is dramatically higher — often above 90 percent, versus roughly 10 to 45 percent for most granites — not because natural stone fabrication is harmless.

Butcher block belongs on an island, not a perimeter. It is warm, it suits Arts and Crafts cabinetry, and it will not survive next to a range without diligent oiling. It pairs well with the warmer palettes replacing all-white kitchens.

Standard engineered stone comes last right now — not because it is a bad surface, but because it is the one material whose supply chain is the explicit subject of an active state rulemaking. If you specify it anyway, do it with a written silica content figure and a fabricator you have actually vetted. The question to ask your fabricator that has nothing to do with your kitchen

Ask whether they wet-cut, whether they use local exhaust ventilation, and whether their crew wears respiratory protection. A shop doing this properly will answer without hesitating and will usually offer to show you.

Here is the opinion we will put in writing, which you will not find on most contractor blogs: if one fabrication bid comes in dramatically below the others, that gap is usually not efficiency. Dry-cutting is faster and cheaper than wet-cutting, and the discount is being paid for out of someone's lungs. We would rather lose a bid than win one that way.

Where this sits in a real Pasadena kitchen budget

Countertops are rarely the line item that decides a kitchen. The ranges we publish in our remodeling FAQ for Pasadena kitchens are roughly $25,000–$55,000 for a cosmetic refresh, $65,000–$135,000 for a mid-range remodel, and $150,000 and up for a full custom or open-concept kitchen. Within any of those, moving between porcelain, granite and engineered stone typically shifts the total by a few thousand dollars — less than a cabinetry decision, and far less than a layout change or a whole-home renovation.

Do you need a permit?

A like-for-like countertop replacement generally does not require a City of Pasadena permit. You cross into permit territory when the work moves a sink or gas line, adds island electrical, or removes a wall. The City of Pasadena Planning & Community Development counter is the authority on which of those applies to you. The same threshold logic governs home additions and ADU projects, where permits are a given rather than a question.

What we would do if this were our own kitchen

Specify porcelain or natural stone. If the design genuinely needs engineered stone, insist on a low-silica product with a written spec sheet and a fabricator who wet-cuts. Then revisit the decision in six months, because this rule is going to move.
